Terms of Service

Plain-language terms for using Rose City Process Servers.

Who we are

Rose City Process Servers ("RCPS", "we", "us") is a sole proprietorship based in Windsor, Ontario. You can reach us at info@rosecityprocessservers.ca or (226) 773-4813. By placing an order or using this website you agree to these terms. Our Privacy Policy explains how we handle your information.

What we do

We deliver legal documents to a named person at an address you give us, in Windsor and Essex County, Ontario, and we prepare a sworn Affidavit of Service describing what happened. Depending on the order, we may also help with court filing, document retrieval, or notices, as described on our website. We are a process serving business. We do not give legal advice, and nothing on this website or from us is legal advice. If you are unsure what to serve, how, or by when, please ask a lawyer or paralegal.

How pricing works

  • Our serving rates are flat rates for the service type and area you choose (standard, rush or same day, in Windsor or elsewhere in Essex County). The rate you see when you order is the base price. HST (13%) is added.
  • The first 25 pages of your documents are included in the base price. Each page after that is $0.25 (black and white), plus HST. When you upload your documents with your order, the page count is worked out for you and the extra page charge is added at checkout. If we receive your documents another way, extra pages are invoiced afterward.
  • If a file cannot be counted automatically, you are charged the base price at checkout, and we may check the pages and invoice any difference.
  • Promo codes reduce the base service price only. They do not reduce the page charge.
  • Work that is not covered by a flat rate (for example, unusual travel, extra attempts you request, or special handling) is quoted to you before we do it.
  • Card payments are handled by Stripe. We never see or store your card number.

What we ask of you

  • The information you give us (names, addresses, document details) is accurate and complete to the best of your knowledge.
  • The documents you give us are lawful to serve, and you have the right to give them to us.
  • You are responsible for deciding what must be served, on whom, and by what deadline. We carry out the delivery you ask for.
  • You will not ask us to do anything unlawful or misleading, or to serve a person by pretending to be someone else.

No guarantee of a result

We make honest, documented attempts at the address you provide. We cannot guarantee that a person will be home, will be found, or will accept the documents, or that a court will accept the service. We serve at a known address only. We do not locate people. The Affidavit of Service records the facts of what we did.

Cancellations and refunds

If you cancel before we have started work on your order, you will receive a refund of the amount you paid, less any card processing fees we cannot recover. Payments made by Interac e-Transfer are refunded by e-Transfer to the sender. Once an attempt has been made, or filing or retrieval work has begun, the service has been provided and the flat rate is not refunded. If we are unable to carry out your order at all, we will refund it. If you think something went wrong, contact us and we will look at it fairly.

Your uploaded documents

If you upload documents, they are used only to carry out your order. We keep them for 7 years after your booking is paid and then delete them. Uploads that are not used in a booking are deleted after 3 days. You can ask us to delete your documents earlier by email. See our Privacy Policy for details.

Limits on our responsibility

We will do our work with reasonable care and skill. To the extent the law allows, our responsibility to you for any problem with our services is limited to the amount you paid us for the order in question, and we are not responsible for indirect or consequential losses, such as a missed court deadline caused by information or documents given to us late or incorrectly. Nothing in these terms limits any right you have under Ontario or Canadian law that cannot be limited by agreement.

Changes to these terms

We may update these terms from time to time. The version in force when you place an order applies to that order. The date at the bottom of this page shows when it was last updated.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be dealt with in the courts of Ontario.
