What the Small Claims rules require

Ontario's Small Claims Court Rules say a plaintiff's claim or defendant's claim "shall be served personally as provided in rule 8.02 or by an alternative to personal service as provided in rule 8.03." There is a deadline too: "A claim shall be served within six months after the date it is issued, but the court may extend the time for service."

Proof matters as much as the serve. Service "may be proved by an affidavit of service (Form 8A) of the person who served it," and that is what we give you: a sworn Form 8A from the person who actually made the serve. See a sample Form 8A affidavit (PDF), with invented details.

What we need from you

  • The issued claim (with the court's seal and file number) and any other documents to be served.
  • The full name of each defendant and the address where they can be found.
  • Anything that helps: a description, usual hours, a vehicle, a unit or buzzer number.

We do not draft claims, choose forms or give legal advice. For that, speak with a lawyer or licensed paralegal, or use the court's own guides.

Questions

How long do I have to serve my Small Claims claim?

The Small Claims Court Rules say a claim must be served within six months after the date it is issued, and the court may extend the time for service.

What proof of service do I get?

A sworn Affidavit of Service (Form 8A) from the person who served the claim, emailed to you and ready to file.

Can you leave the claim in the mailbox?

No. Dropping papers in a mailbox is not personal service. We serve the person, and if that is not possible we report back so you can decide on the next step under the rules.

Can you serve two defendants at once?

Yes. A second person at the same address, during the same visit, is +$40.

Where we serve

All of Windsor and Essex County: Windsor, LaSalle, Tecumseh, Amherstburg, Lakeshore, Essex, Kingsville, Leamington. Mileage is included everywhere, and the price table has them all.

General information, not legal advice. Rule quotations are from the Ontario regulations linked on this page; forms and rules change, so always check the current version for your court.
